Can you sell an owner-builder home?

Yes, you can sell an owner-builder home — but if you sell within your state's disclosure window (commonly 6 to 7.5 years), you must give the buyer specific warnings, and in some states a defects report and warranty insurance.

Selling is allowed — with strings for a set period

Owner-builders can sell their home. What changes is the disclosure and warranty obligation that applies if you sell within a defined window after the work — designed to protect the buyer of an owner-built home. Sell after the window closes and most of these obligations fall away.

What the sale window requires (varies by state)

  • A conspicuous owner-builder warning in the contract of sale — the permit, its date, and that the work isn’t builder-insured. (NSW: within 7.5 years of the permit.)
  • A defects inspection report in some states — Victoria’s section 137B report, prepared by a prescribed practitioner, within 6.5 years of completion.
  • Warranty / domestic building insurance for the buyer in states like Victoria and WA, where the work exceeded the threshold.
  • Statutory warranties on your work (commonly 6 years for major defects) that pass to the buyer and are enforceable against you personally.

Plan for it before you build

If there’s any chance you’ll sell inside the window, price these obligations in now — a warranty policy and a defects report are the difference between a normal sale and a discounted one.
